1. ACCEPTANCE OF TERMS

By accessing and using MOT Ninja ("the Service"), operated as a sole proprietorship ("we", "us", "our"), you ("the User") accept and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you must not use the Service.

2. SERVICE DESCRIPTION

MOT Ninja provides vehicle history information aggregated from publicly available sources and licensed third-party data providers, including:

  • Driver and Vehicle Licensing Agency (DVLA) data
  • Driver and Vehicle Standards Agency (DVSA) MOT test records
  • Vehicle Data Global Limited (VDG) - stolen vehicle checks, write-off history, outstanding finance, mileage verification
  • Police National Computer (PNC) via authorized third parties
  • Motor Insurance Anti-Fraud and Theft Register (MIAFTR)

The Service generates a risk assessment score ("Decision Ribbon") based on algorithmic analysis of available data.

Premium Reports: For £9.49, premium reports include enhanced checks from commercial data providers. These checks are subject to third-party data availability and accuracy. Cost reflects data licensing fees.

3. NO RECOMMENDATION OR ADVICE ⚠️

IMPORTANT DISCLAIMER:

THE DECISION RIBBON SCORE AND ALL INFORMATION PROVIDED BY THE SERVICE ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE:

  • A recommendation to purchase or not purchase any vehicle
  • Professional advice (mechanical, legal, financial or otherwise)
  • A warranty, guarantee or certification of vehicle condition
  • A substitute for independent inspection and due diligence

The Service provides a general risk assessment based solely on historical data available at the time of query. It does not and cannot:

  • Predict future vehicle performance or reliability
  • Identify undisclosed accidents, repairs or modifications
  • Verify the accuracy of seller representations
  • Assess current mechanical condition

YOU ARE SOLELY RESPONSIBLE for making your own informed decision regarding any vehicle purchase, including:

  • Conducting a thorough physical inspection
  • Obtaining an independent mechanical assessment
  • Reviewing all documentation and provenance
  • Test driving the vehicle
  • Verifying seller identity and legal ownership
  • Ensuring compliance with all applicable laws and regulations

4. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOT NINJA SHALL NOT BE LIABLE FOR:

  • Any damages arising from use or reliance on the Service
  • Vehicle purchases or decisions made based on Service data
  • Errors, omissions, inaccuracies or delays in data
  • Vehicle defects, faults, or failures not identified by the Service
  • Loss of profits, revenue, data, or opportunity
  • Third-party data errors or service interruptions

Maximum Liability:

Our maximum aggregate liability shall not exceed the amount paid by you for the specific report giving rise to the claim (maximum £9.49 for premium reports, £0 for free reports).

Nothing in these Terms excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability which cannot be excluded under applicable law.

5. DATA ACCURACY AND AVAILABILITY

NO WARRANTY OF ACCURACY:

We provide data "AS IS" and "AS AVAILABLE" without warranty of any kind. We do not warrant that data is accurate, complete, current, or reliable.

THIRD-PARTY DATA:

The Service relies on third-party data sources (DVLA, DVSA, TfL) over which we have no control. We assume no responsibility for errors, omissions or delays in third-party data.

HISTORICAL DATA:

All data reflects historical records and may not represent current vehicle condition. Vehicle condition can change due to wear, damage, repairs, or modifications occurring after the most recent recorded data point.

6. GOVERNING LAW AND JURISDICTION

Governing Law: These Terms are governed by the laws of England and Wales.

Jurisdiction: The courts of England and Wales have exclusive jurisdiction over disputes.

EU Users: Where you are a consumer resident in the EU, you may also have rights under local consumer protection laws. These Terms do not affect those mandatory rights.

7. CONSUMER RIGHTS NOTICE

If you are a consumer, these Terms do not affect your statutory rights under UK or EU consumer protection legislation, including:

  • Consumer Rights Act 2015
  • Consumer Protection from Unfair Trading Regulations 2008
  • EU Consumer Rights Directive (for EU residents)
